Acceptance of Terms

These Terms of Service apply to prosaround.com and to the operator dashboard at business.prosaround.com. By using either one you agree to these terms. If you do not agree, please do not use them.

Who May Use Pros Around

Pros Around is for adults. You must be at least 18 years old to send a request, write a review or create an account. If you are under 18, please ask an adult to do it for you.

Description of Services

Pros Around is a directory and lead platform. It lists independent local professionals (“pros”) and passes requests and phone calls from customers to the pro they choose.

Pros Around is for people in the United States.

Pros Around does not perform the services it lists, does not employ or supervise pros, and does not guarantee any pro's work, price, license or availability.

User Accounts

• Customers do not need an account. To request a quote you give your name, phone number and what you need done.
• Pros need an account with a business profile: business name, owner name, phone, email, service, city and, where the law requires one, a license number for a licensed profession (for example a contractor, bar, medical or CPA license), which we check before the listing goes live.
• Give accurate information, keep your password private, and tell us if you think someone else has used your account. You are responsible for what happens under it.

Operator Obligations

• Hold every license, registration and insurance your work requires, and keep your listing truthful: services, service area, years in business and photos.
• Contact a customer only as they agreed when they sent the request, and use their details only to respond to it.
• Do not post fake reviews, offer incentives for reviews, or pressure customers to change or remove one.
• Do not interfere with the platform, scrape it, or use it to find customers for another service.
• Your page address: you may choose the name in your page address (for example prosaround.com/pros/your-name) once every 30 days. Do not choose a name that copies or could be mistaken for another business, person or Pros Around itself. We may change or remove a name that does, or that is offensive, and keep short names for a premium option we may offer. Your old address redirects to the new one.
• Importing from your website: when you give us your website address, we read the public pages of that site to suggest your description, address, hours, links and pictures. You choose what to add. You confirm you own the site and the pictures you add, or have the right to use them.

Payment Terms

• Leads: you top up a balance and each qualified lead is charged to it at its price. The price depends on the service, the city the lead came from and your plan, and is published in your dashboard. A lead is a call of 30 seconds or more, or a quote request. Repeat contacts from the same person within 24 hours count once. The price per lead is set by our published pricing rules and is shown to you before you buy.
• Your balance is pay as you go and does not expire. It is not refundable, with one exception: the 30-day return. Within 30 days of paying your first top-up you may ask us to return the unspent part of it to your card, once. We return the smaller of what is left on your balance, the balance that top-up added and what your card was charged for it, so later top-ups and any bonus are not part of it. We cannot make a return while a card payment of yours is being disputed with your bank. You ask for it from the Credits page in your dashboard. See the refunds page.
• Chargebacks: if a card payment is disputed with your bank, we pause your leads while it is decided and take back the balance that payment bought, including any you have already used, so your balance can go below zero until you top up. A disputed plan payment cancels the plan. If the bank decides in your favour, the balance is restored and your leads switch back on. If it is decided against you, your account stays paused for review, and a second lost dispute closes the account.
• Plans and the Featured badge are monthly subscriptions with no contract. They renew each month until you cancel, and a cancellation takes effect at the end of the period you have paid for. Payments are processed by Stripe.
• Disputed leads: you can dispute a lead from your dashboard within 7 days of receiving it. If we agree it was spam or a wrong number, the amount charged for it is returned.
• If you pay for a plan or badge that turns out to be unavailable (for example, someone took the slot a moment earlier), we cancel it and refund the first payment.
• Tax: prices are shown before any sales tax. If tax applies to your purchase, Stripe shows it before you pay.

Customer Obligations

• Give accurate contact details and a real request. Do not submit requests as a joke, to test the form, or on behalf of someone who did not agree.
• Do not abuse the quote system: no spam, automated submissions or repeated requests meant to cost a pro money.
• Write a review only about a pro you actually dealt with.

Reviews & Content Policy

• Only people who contacted a pro through Pros Around can review that pro. Reviews are tied to a real request.
• Pros can reply to a review but cannot remove it, and a review is never removed because it is critical.
• We remove content that is spam, fake, off topic, abusive, or that shows private details such as faces or home addresses. When an administrator hides a review, the reason is recorded.
• By posting a review or photo you let Pros Around display it publicly and keep it while the pro is listed.

Intellectual Property

The Pros Around name, logo, site design and software belong to Pros Around. Pros keep ownership of their own logos, photos and descriptions, and give us permission to display them on their listing and in the directory. Customers keep ownership of their reviews and give us permission to display them as described above.

If You Add Our Form Tracking Script to Your Website

The Form Tracking add-on gives you a script to put on your own website. It stores a campaign tag and the page a visitor first came from in the visitor's browser (for the visit, and for up to 90 days) so that a form sent from your site can be credited to its source. We do not use it to follow visitors across other sites.

You run your website, so you must tell your visitors about this on it (for example in your privacy policy) and get any consent that the law where they live requires before you load the script. If you cannot do that for a group of visitors, do not load the script for them.

Copyright and Content You Post

You may post only photos, logos, text and other material that you own or have permission to use. By posting it you confirm that, and you let Pros Around display it as described above. If you post something that copies another person's work, we may remove it and, for repeat infringers, end the account.

To tell us that something on the site infringes your copyright, or to answer a notice, follow the steps on our copyright (DMCA) page.

Limitation of Liability

Pros Around is not responsible for the quality, safety, price or timing of any pro's work, or for what happens between a customer and a pro. The site is provided “as is”.

To the fullest extent the law allows, Pros Around is not liable for indirect or consequential losses, and its total liability to you for any claim is limited to the amount you paid Pros Around in the 12 months before the claim.

Dispute Resolution

If you have a problem with Pros Around, please tell us first so we can try to resolve it informally. These terms are governed by the laws of the State of Arizona. Any claim that cannot be resolved informally will be brought in the state or federal courts located in Maricopa County, Arizona.

Disagreements between a customer and a pro about their work are between them; we may help by looking at the request record and any call recording.

Termination

• You can stop using Pros Around at any time. Pros can cancel plans and the Featured badge from their dashboard and delete their account from Account settings.
• We may suspend or remove an account or listing that breaks these terms, for example for fake reviews, misleading information, abuse of the quote system or unpaid charges.

Changes to Terms

We may update these terms. When we do, we change the date at the top of this page. If you keep using Pros Around after that, you accept the new terms. For changes that affect how pros are charged, we tell pros by email first.
