How to send a notice
A notice must be in writing and include all of these (17 U.S.C. 512(c)(3)):
- Your physical or electronic signature, as the copyright owner or a person allowed to act for the owner.
- A description of the copyrighted work you say was copied. If several works are covered, a list of them.
- The address (URL) of the page, or a clear description of where on the site the material is, so we can find it.
- Your name, postal address, telephone number and email address.
- A statement that you believe in good faith that the use is not allowed by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act for the owner.
Knowingly claiming that material infringes when it does not can make you liable for damages (17 U.S.C. 512(f)). If you are not sure, ask a lawyer first.
What we do with a notice
- We review it. If it is complete, we remove or disable access to the material promptly.
- We tell the person who posted it, with a copy of the notice (your contact details may be included), and tell them how to answer.
- If the notice is incomplete, we may ask you for what is missing before we act.
- We keep a record of each notice and what we did.
If your content was removed: counter-notice
If you posted material that was removed and you believe it was a mistake or that you have the right to use it, send a counter-notice to the address above with (17 U.S.C. 512(g)(3)):
- Your physical or electronic signature.
- What was removed and where it appeared before it was removed.
- A statement, under penalty of perjury, that you believe in good faith that it was removed because of a mistake or a wrong identification.
- Your name, address and telephone number, and a statement that you consent to the federal court for your address (or, outside the United States, any court where Pros Around can be found) and that you will accept service of process from the person who sent the notice.
We send the counter-notice to the person who made the first notice. If they do not tell us within 10 business days that they have started a court case, we may put the material back between 10 and 14 business days after we received your counter-notice.
Repeat infringers
We end the account of a pro or other user who is a repeat infringer. In practice, a person who has had two or more valid copyright notices upheld against material they posted will lose access to post on Pros Around. We may act sooner for serious cases. A removed photo that is replaced by a counter-notice does not count against you.
Other content problems
To report something that is not a copyright issue, such as a photo of a person's face or home address, a fake review or an incorrect listing, use our Contact page and choose “Remove or correct a listing”. See also our Terms of Service and Privacy Policy.
